 Malaysia v Kesultanan Sulu over Sabah..

PostSubject: Malaysia v Kesultanan Sulu over Sabah..   Sat Mar 09, 2013 7:40 pm

Berdasarkan fakta malaysia harus bayar uang sewa tahunan kepada kesultanan sulu atas peminjaman wilayah sabah, maka menurut gw sabah adalah milik kesultanan sulu and by extension masuk wilayah filipina.

Sama, info gw juga sebatas tulisan di media.

Yg gw pahami awalnya sabah masuk wilayah sulu, trus inggris masuk dan menguasai borneo utara termasuk sabah, khusus sabah disepakati inggris sewa wilayah (mirip hongkong dan makau lah) dan bayar uang tahunan, trus waktu inggris mau ninggalin borneo dan mengalihkan penguasaan atas borneo ke malaysia, disepakati malaysia akan melanjutkan perjanjian yg dibuat inggris khususnya terkait sabah.

Krn sulu skrg masuk malaysia, maka klaim atas sabah jatuh kepada filipina, dan hal ini diperkuat dgn keputusan mahkamah agung filipina yg menguatkan undang-undang ttg sabah.

Kalo diliat dari sejarahnya, gw bilang klaim sulu uda bener.

terlepas dari bener salah, si sultan klaim buat negara sendiri dengan wilayah sabah atau klaim untuk dan atas nama malaysia?

sikap filipina sendiri gimana?

Tadi salah nulis, sulu masuk filipina bukan malaysia..

Yg gw baca sulu klaim sbg wilayah mereka bukan untuk jadi filipina...sepertinya mereka tetap merasa monarki yg independen dari filipina...nah filipina jd ikut2an krn de jure dan de facto sulu masuk wilayah mereka, jd klaim sulu atas sabah dari sulu by extension jd klaim filipina.

Filipina sih happy go lucky aja, dapat syukur, gak dapat gak mewek.makanya mereka sempet melepas klaim atas sabah, trus keputusan itu di-judicial review dan diovertuned mahkamah agung mereka.

The North Borneo dispute is a territorial claim by the Philippines over much of the eastern part of Sabah in Malaysia. Sabah was known as North Borneo prior to the formation of the Malaysian federation in 1963. The Philippines, via the heritage of the Sultanate of Sulu, claim Sabah on the basis that Sabah was only leased to the British North Borneo Company with the sultanate's sovereignty never being relinquished.
This dispute stems from the difference in the interpretation used on an agreement signed between Sultanate of Sulu and the British commercial syndicate (Alfred Dent and Baron von Overback) in 1878, which stipulated that North Borneo was either ceded or leased (depending on translation used) to the British chartered company in return for payment of 5,000 dollars per year.
However, Malaysia views this dispute as a "non-issue", as it not only considers the agreement in 1878 as one of cession, but it also deems that the residents had exercised their act of self-determination when they voted to join the Malaysian federation in 1963.[39][40] As reported by the Secretary-General of the United Nations, the independence of North Borneo was brought about as the result of the expressed wish of the majority of the people of the territory as supported by the findings of the Cobbold Commission.[41]
Every year, the Malaysian Embassy in the Philippines issues a check in the amount of 5,300 ringgit (US$1710 or about 77,000 Philippine pesos) to the legal counsel of the heirs of the Sultan of Sulu. Malaysia considers the amount an annual “cession” payment for the disputed state, while the sultan’s descendants consider it “rent". The sultan's descendants demands that the payment be increased to 1Billiion USD in 2010, Malaysia has however ignored the issue.[42][43]

ini kerajaan kalaupun bisa dapet pengakuan internasional juga tetep bakal ribut kayanya..gw baca2 ternyata 4 orang yang ngaku paling berhak jadi raja sulu..yaa soal kekuasaan mah bsa dibagi2 sih..

btw, gw baca kok katanya udh ada refrendum gtu ya di sabah taun 1963, hasilnya penduduk situ maunya ngikut ke malaysia..itu yg jadi dasar malaysia klaim wilayah sabah..tp ngapain masih bayar royalti/sewa klo udh ngerasa punya?

Kalo soal rebutan internal emang bakal ngaruh sama legal standing menggugat ke mahkamah internasional sih....kecuali kalo pemerintah filipina sendiri yg maju..

Nah, itu dia lubang di argumen malaysia, kalo emang punya mereka ngapain smp skrg msh bayar uang tahunan? Kecuali ternyata sblmnya emang disepakati malaysia bayarnya nyicil.

All things considered, gw bilang klaim sulu mungkin ada benarnya, apalagi tau sendiri malingsia alias maygaysia kan emang tukang klaim.

klo dr sejarah sih gw jg lbh condong ke sulu,tp klo liat realitanya,berat buat balikin eksistensi si sulu lagi..selaen rebutan siapa yg berhak jd raja, sulu jg udh ga punya massa di sabah sendiri..
ga kaya GAM ato Papua yg emg issue nya didukung ama uprising dr org2 di wilayah itu..kecuali filipina yg maju,trus kesultanan masup jd wilayah otoritas dibawah filipin nantinya..yaa itu juga filipin itung2an,ntar udh susah2 dibantuin ujung2nya sulu malah cabut berikut wilayah filipin selatan muslim yg laen kan..untung kaga, lihaw iyee..

malesia mah negara yg identitasnya gajelas..makanya maen klem2 ajee..lha wong sultannya aja ada yg org padang (negeri sembilan) ada yg org bugis (selangor)..

Best chance sulu bawa sengketanya ke mahkamah internasional, kalo fisik emang gak mungkin menang..

sebelum itu gw pilih dia jadi beligerence dulu deh. kalo udah sering aksi kaya IRA, dikenal dunia internasional, baru bawa ke mahkamah. kalo cuman mengandalkan dokumen doang susye. the odds is not in your favor.
